Sam Morgan’s practice focuses on advising and representing non-union employees in employment-related legal disputes. The vast majority of his work involves litigation, including lawsuits alleging wrongful termination, all forms of illegal employment discrimination (especially age, race, gender and disability discrimination), sexual harassment, “Whistleblowers” and other unlawful retaliation, breach of employment contract (retention agreements, bonuses, commissions) non-payment of wages and overtime pay, non-competition and non-solicitation agreements, disputes over the misappropriation, use and/or disclosure of proprietary information and/or trade secrets. Sam has particular expertise in executive compensation disputes, and disputes involving minority equity owners and shareholder oppression, as well as public sector (i.e., government employee) employment rights.

On the advice and counsel side, Mr. Morgan assists both employee clients with employment contracts, executive compensation, and the negotiation of severance pay and separation agreements.

Mr. Morgan is AV-rated (“Preeminent”) by Martindale-Hubbell, is a Fellow of the College of Labor and Employment Lawyers, and has been listed in Best Lawyers in America and Michigan SuperLawyers every year since 2007 for his work in Employment Litigation. He is a 1981 graduate of the University of Michigan in Ann Arbor, and 1984 graduate of Michigan State University College of Law.

This includes assisting individuals with their pre-hire issues, including advice and counsel and/or representation in negotiations over employment contracts, compensation arrangements, and non-compete/non-solicitation agreements. Advice and counsel when an employee’s continued employment is in jeopardy of termination, or when they are being harassed illegally. Post-termination advice and counsel, including review and negotiation of severance agreements, and litigation of wrongful termination cases involving claims of illegal employment discrimination and/or retaliation, sexual and other forms of illegal harassment, non-payment of compensation, including wage and hour claims under the Fair Labor Standards Act (“FLSA”), breach of employment contract, and defense against non-compete agreement and other restrictive covenant enforcement lawsuits.
